Specific terms for OpenAuction

Dissemination of auction:

OpenAuction is the provider of free auctions and is only responsible for the communication between the buyer and seller. Seller is responsible for the nature and condition of the product and is the sole responsible with regard to reprimand and complaint.

Auction rules on OpenAuction:

It is free to sell and bid. The winner of the auction is the one who made the highest bid at the end of the auction.

It is not possible to change the price of your item once a bid has been laid down.

It is not allowed to put an item on auction under two or more universes, categories, item types, genres etc.

After winning an auction, the buyer has 48 hours to pay for the purchased item. If this does not happen, the seller has the right to reopen the auction.

When you buy or sell for the first time at OpenAuction you will be asked to register your adress. This wil automatically be stored and used henceforth each time you buy or sell. When an auction ends OpenAuction send an e-mail containing a link with contactinformation to buyer and seller. Be well aware that you can only open the link when logged in on OpenAuction. This will eliminate the risk that your contactinformation is forwarded to a third party. 

Payment is only a question between the seller and the buyer. Freight is only a question between seller and buyer. Thus, OpenAuction has no responsibility in these two regards.

Registration as a user on OpenAuction:

To register a user profile on OpenAuction, you must fill in your name, email and password and accept the terms of use of the site.

It is optional to add additional information to a user profile such as zip code, image, etc.

It is free to create a user on OpenAuction and you can unsubscribe at any time, unless:

• You have created an auction which has not yet ended

• You have laid a bid on an active auction, which is still the highest

A user profile at OpenAuction is personal and must not be shared with others, as you may only create one user profile.

OpenAuction reserves the right to disable or delete a user profile that does not comply with our Terms and Conditions at any time.

Being a user at OpenAuction, OpenAuction may contact you by email with necessary service announcements.

When will the auction start and end:

The start and end times are always indicated for each auction. It is only the seller who determines the duration of the auction, however though max. three weeks.

How many bids can I submit:

You can issue an unlimited number of bids.

Rejection of items put up for sale:

OpenAuction reserves the right to delete auction items that obviously do not fit the categories within which they are offered or items that are obviously worthless.

OpenAuction.org is entitled to reject bids that fall below a minimum auction price.

OpenAuction is not responsible in any way for bidders violating the rules for bidding, including the submission of bids from an agent under the age of 18 or doubt that the buyer is not able to pay the purchase price due to bankruptcy or other form for insolvency. However, in case of obvious violation of the rules for bidding OpenAuction reserves the right to reject the bids in question.

If a bid does not arrive due to Internet problems or other technical issues, OpenAuction is not responsible for this.

If you have created an account with OpenAuction, you agree that OpenAuction has the intellectual property of product description and images and you agree that such may be used and edited freely for use by the OpenAuction Encyclopedia and for further promotion of OpenAuctions business activities.

OpenAuction does not accept responsibility for the user's use of the site and the published information, materials and utterances.

OpenAuction reserves the right to delete profiles who post racist, homofobic, antisemitic, islamofobic, misogynistic or other offensive and derogatory utterances and material.

Copyright:

Such fotos, texts, musicfiles etc. that are protected by copyright/intellectual property right are not allowed to appear on OpenAuction. If your use of OpenAuction entails showing of/giving access to pictures, fotos, texts, videos, musicfiles etc. protected by copyright/intellectual property right, you will be responsible that no rights of a third party, including the aforementioned rights, are violated. Consequently you are responsible that the use of other persons texts, pictures, fotos, music, videos etc. at any time complies to the law in the country in which the auction takes place. Furthermore it is your responsibility to comply to rules and regulations in force at any time. OpenAuction disclaims any responsibility for violations of the aforementioned rights and will transmit any request in this respect to you.

General Terms

Returns:

When you participate in an auction, please be aware that you are covered by laws and rules including the Consumer Agreement Act. Enforcement and sanctions under these laws and rules are not the responsibility of OpenAuction. Enforcement and sanctions are solely a matter between the seller and the buyer.

According to current law, you have 14 days from the date you receive the item to notify the seller of withdrawal. The message must be clear and must be given to the seller by e-mail or telephone, or by sending the default cancellation form to the seller.

Warranty:

Also, be aware that you are covered by the protection rules in the Purchasing Act. If you receive a product that does not live up to what you rightly expect, you have 24 months of warranty. The right of claim can not be claimed against OpenAuction and is solely a matter between the buyer and the seller. The right of promotion means that you can either get the item repaired, exchanged, the money back or reduction in the price, depending on the specific situation. It is a requirement that the complaint is justified and that the defect has not arisen as a result of improper use of the product or other harmful behavior.

You must advertise within "reasonable time" after you have discovered the defect of the item. If you advertise within two months after the defect has been discovered, the complaint will always be timely.

Any freight in return will in principle be due to you and will not be refunded.

Privacy:

When you create a user profile on OpenAuction we register the information you provide about name, email and password. Further information you provide in your user profile is optional. However, would you like to create auctions or bid on auctions, you must provide name, address, zip, city and country.

OpenAuction is responsible for collecting and managing data. Your information will not be sold or disclosed to third parties. As a registered user, you always have the right to access and you may object to a registration in accordance with the rules of the Personal Data Act and contact with: post@OpenAuction.dk

Model withdrawal form:

This form may be printed or copied and sent to the seller if you wish to cancel the purchase. The form is optional and you can also notify the seller per. email or phone.
